These general terms and conditions (in the further "GTC") determine the usage rules of the website operated by Momotime.ch and its management (in the further "seller") and also apply to delivery contracts that the seller concludes with the consumer (in the further "customer")) .

Momotime.ch reserves the right to change terms and conditions, whereby the state of the terms and conditions applicable at the time of the order must be considered decisive.

Offers and prices

By clicking the button that concludes the order process, the customer submits a legally binding offer in relation to the item inventory defined in the shopping cart.

Prices and presentation of the offer on the website are generally non -binding and specified in CHF.

Order and contract

The contract will be legally valid when the order is sent. The seller has to withdraw from the contract if there are obvious writing and invoice errors in the order. The customer's order confirmation, which is available when the order process is concluded, is decisive for the scope of goods and services.

When the contract is concluded, the customer is available to receive occasional information on offer, promotions, etc.

Both the order processing and any contacts take place by email, which the customer specifies on the condition that they can receive the information sent by the seller and the information can be delivered.

The delivery of the goods in the seller's distribution center is considered to be the delivery at when use and danger pass to the customer.

If the order has been ordered, the customer is in any case obliged to remove and pay the ordered goods. The goods are delivered to postal instructions in Switzerland. If the supplier does not find a recipient for the delivery to the time window and address set in the order, the latter deposits the goods and the package on the front door or mailbox. In this case, the seller assumes no responsibility for improperly deposited, stored, damaged and stolen goods and packages. The delivery takes place according to the date noted in the order.

In the case of delivery bottlenecks, the customer who has placed an order is informed accordingly and must withdraw the right in writing from the contract, as long as the application received 3 days before the newly agreed date. In the case of delivery bottlenecks, the customer will be informed about a reasonable replacement date as soon as possible.

Warranty

Manipulations on the part of third parties or customers, natural wear and tear, delays by the transport service provider, improper handling, excessive stress on the goods and packaging, force majeure and extreme environmental influences are factors that the seller is not responsible.

The seller assumes no responsibility in the event of any further sales of the goods. In such cases, the customer who resold the goods is to be considered liable.

In principle, the seller delivered is not withdrawn by the seller.

Payment variants

Payments are made using PayPal or credit card.

If payment terms are not met, the seller is entitled to make claims against the customer immediately or to request collateral for outstanding claims. In such cases, outstanding deliveries are only to be carried out against advance payment.
